In plain English: our advertised offers are exactly what they say. One offer per booking, mention it when you call, and the fixed price we quote before starting is the price you pay. Nothing on this page takes away the rights you have under Australian Consumer Law.

About These Terms

1. These Promotional Terms and Conditions govern all promotions, offers, discounts and deals (each an Offer) advertised or made available by Essential Trades Group Pty Ltd (ACN 679 680 543) trading as Wollongong Plumbing and Hot Water (we, us, our or the Promoter).
2. In these terms, a reference to you, your or a Participant is a reference to the person taking up an Offer.
3. Participation in or redemption of any Offer is deemed acceptance of these Promotional Terms and Conditions.
4. These Promotional Terms and Conditions are in addition to, and do not replace, our standard terms and conditions of service. If there is any inconsistency between the two, these Promotional Terms and Conditions prevail to the extent of the inconsistency in relation to an Offer.
5. Our standard terms of service (including our fixed-price quoting process, right to refuse service, worker safety and other service terms) continue to apply to all work performed. Our pricing page explains how every quote is built.

Eligibility

1. Offers are open to Australian residents only.
2. Offers apply to properties within our Wollongong, Shellharbour and Kiama service area. Ask when you call if you are unsure whether your suburb is covered.
3. To be eligible for an Offer you must mention the relevant Offer, promotion code or discount at the time of booking with us, whether by phone, email or otherwise (Booking).
4. In line with our group policy, we cannot accept Bookings from tenants directly. If you rent, your landlord or property manager must make the Booking.

Redeeming an Offer

1. Only one (1) Offer may be redeemed per Booking.
2. Offers cannot be used in conjunction with any other offer, promotion or discount unless we agree otherwise at our discretion.
3. Offers are not redeemable for cash and cannot be transferred to another person or property.
4. Offers are subject to availability and may be withdrawn, modified or replaced at any time without notice. An Offer already applied to an approved quote will be honoured.
5. We reserve the right to refuse to honour any Offer where we reasonably believe it has been used fraudulently or inappropriately.

Pricing and Additional Fees

1. We do not charge a call-out fee and we do not apply after-hours loadings. Getting a licensed plumber to your door, assessing the job and giving you a fixed price costs you nothing.
2. Offers apply to the advertised service or discount only. Where the work required goes beyond the advertised service, additional charges may apply, including but not limited to:
   • parts, materials or equipment outside the scope of the Offer;
   • diagnostic or investigation work, such as CCTV drain inspection or leak detection, where required to quote the job;
   • additional works discovered once the job is under way.
3. Any additional charges will be quoted to you as a fixed price and approved by you before we begin that work. The price you approve is the price you pay, whether the job takes one hour or three.
4. Unless stated otherwise, all prices are in Australian dollars and include GST.

General

1. Consumer Law: Certain legislation, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and similar consumer protection laws, may give you rights, warranties, guarantees and remedies relating to an Offer or our services that cannot be excluded, restricted or modified (Consumer Law Rights). Nothing in these terms excludes your Consumer Law Rights. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
2. Consequential Loss: To the maximum extent permitted by law, and subject to your Consumer Law Rights, neither party will be liable under these terms for any consequential, special or indirect loss, loss of profit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of use or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.
3. Liability: A party's liability in relation to these terms will be reduced proportionately to the extent the relevant liability was caused or contributed to by the acts or omissions of the other party, including any failure to take reasonable steps to mitigate loss.
4. Force Majeure: Neither party will be liable for any delay or failure to perform their obligations under these terms if the delay or failure is caused or contributed to by an event beyond that party's reasonable control, including natural disaster, severe weather, flood, bushfire, civil unrest, war, industrial action, pandemic or epidemic, or any government order or shutdown.
5. Costs: You are responsible for any costs associated with claiming an Offer, including any applicable taxes or charges, other than those we have expressly agreed to cover.
6. Amendments: These terms may be amended or replaced from time to time, including where required by any regulatory authority. The version published on this page at the time of your Booking applies.
7. Jurisdiction: These terms are governed by the laws of New South Wales. Each party irrevocably submits to the exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.
8. Dispute Resolution: If a dispute arises, please contact us first on 1300 707 059 and we will attempt to resolve it with you in good faith. If it cannot be resolved, either party may refer the matter to a mediator, with the costs of mediation shared equally. Nothing in this clause prevents you from contacting NSW Fair Trading.
